Agreement Terms
1. Parties and Agreement
This Equipment Rental Agreement ("Agreement") is entered into between Equip Rental and Supply ("Lessor"), located at 1520 Skyline Rd., Laramie, Wyoming 82070, and the undersigned customer ("Lessee"). This Agreement governs all rentals of equipment owned by Lessor and rented to Lessee.
2. Equipment
The equipment rented ("Equipment") shall be identified on a rental order, invoice, or booking confirmation issued by Lessor. Lessor is the owner of all Equipment. Equipment is rented solely for Lessee’s business or personal use and shall not be subleased or transferred.
3. Rental Term
The rental term begins upon delivery or pickup of the Equipment and ends upon return and acceptance of the Equipment by Lessor in rental-ready condition, unless extended by mutual agreement.
4. Rental Rates and Charges
Rental rates are based on the rates quoted at the time of reservation. Lessee agrees to pay all rental charges, delivery and pickup fees, fuel charges, engine-hour overages, damage costs, and any other charges outlined in this Agreement or on the rental invoice.
5. Delivery and Pickup
Delivery and pickup service is available within Laramie city limits for $50 per trip. Additional charges apply for out-of-town delivery or pickup. Lessee is responsible for ensuring the delivery location is safe and accessible.
6. Engine Hours and Fuel
Equipment rentals include standard engine-hour usage. Engine-hour overages will be charged at $25 per hour. Equipment must be returned with the same fuel level as delivered and fueled with midgrade or premium gasoline where applicable.
7. Use and Operation
Lessee agrees that Equipment will be operated only by qualified, competent persons. Lessor does not provide operators. Lessee assumes all responsibility for training, safe operation, and compliance with all applicable laws and manufacturer guidelines.
8. Maintenance and Care
Lessee shall maintain the Equipment in good condition during the rental period, including routine checks and cleaning. Equipment shall be returned in the same condition as received, ordinary wear and tear excepted.
9. Damage, Loss, or Theft
Lessee assumes full responsibility for any loss, theft, or damage to the Equipment from the time of delivery or pickup until return. Lessee shall be responsible for repair or replacement costs as determined by Lessor.
10. Assumption of Risk and Indemnification
Lessee assumes all risks associated with possession, operation, and use of the Equipment and agrees to indemnify and hold harmless Lessor from any claims, damages, losses, or expenses arising from such use, except to the extent caused by Lessor’s gross negligence or willful misconduct.
11. Insurance
Lessee is responsible for maintaining adequate insurance coverage for the Equipment and its operation. Proof of insurance may be required prior to rental.
12. Default
Failure to comply with this Agreement constitutes default. Upon default, Lessor may terminate the rental, repossess the Equipment, and pursue all available legal remedies.
13. Governing Law and Venue
This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming. Any legal action arising from this Agreement shall be brought in the courts of Albany County, Wyoming.
14. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements. Electronic signatures and acceptance are deemed valid and enforceable.
